1. General Information

These Terms & Conditions apply to all purchases and commissions made through this website.

By placing an order or requesting a commission through this website, you agree to these Terms & Conditions.

2. Products & Services

This website offers:

• Original artworks (one-of-a-kind pieces)

• Art prints (open or limited editions, as specified)

• Commissioned artworks

All artworks are described as accurately as possible.

Please note that colors may vary slightly due to screen settings.

3. Commissions & Commission Agreement

3.1 Commission Process

I offer commissioned artworks with an in-depth consultation to fully understand your vision and wishes.

To request a commission:

• Please provide detailed information about your desired artwork

• Include your contact details via the contact form on this website

• I will contact you to discuss concept, size, materials, timeline, and pricing

A commission is only confirmed once all details are agreed upon in writing.

3.2 Commission Agreement

For each commissioned artwork, a Commission Agreement will be agreed upon, outlining:

• Description of the artwork

• Size, materials, and medium

• Total price and payment schedule

• Estimated timeline

• Revision terms

• Usage and copyright rights

• Cancellation conditions

3.3 Payment for Commissions

• A non-refundable deposit (usually 30–50%) may be required before work begins

• The remaining amount is due upon completion or before shipping, as agreed

3.4 Revisions

• One round of minor revisions may be included if agreed

• Additional revisions may incur extra charges

3.5 Cancellation of Commissions

• If a commission is cancelled after work has begun, the artist may retain the deposit and/or charge for work already completed

• Custom and commissioned artworks are excluded from the right of withdrawal under EU law (§ 312g Abs. 2 Nr. 1 BGB)

4. Prices & Payment

• All prices are listed in Euro (€)

• Prices do not include shipping costs, unless stated otherwise

• Shipping costs are paid by the buyer

Accepted payment methods:

• PayPal

• Credit Card

Orders are processed only after full payment is received, unless otherwise agreed.

5. Shipping

• Shipping is worldwide, insured, and secured

• All artworks (originals and printed editions) are packaged with great care to ensure safe delivery

• Shipping costs are paid by the buyer

In accordance with EU consumer law:

• Responsibility for the artwork remains with the artist until delivery to the buyer

• In case of loss or damage during transport, please contact me promptly so I can assist with the claim process

I am not responsible for delays caused by shipping providers or for issues occurring after confirmed delivery.

6. Customs & Import Fees

For international orders outside the EU, customs duties, taxes, or import fees may apply.

These costs are not included in the purchase price and must be paid by the buyer.

7. Right of Withdrawal (Widerrufsrecht)

7.1 General Right of Withdrawal

Consumers within the EU have the right to withdraw from the contract within 14 days without giving any reason.

The withdrawal period begins on the day you receive the goods.

To exercise your right of withdrawal, please contact me via email with a clear statement of your decision.

7.2 Effects of Withdrawal

• Returned items must be unused and in original condition

• The buyer bears the cost of return shipping

• Refunds will be issued after the returned item has been received

7.3 Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to:

• Commissioned or custom-made artworks

• Personalized items

• Digital products, if offered, once delivery has begun

8. Returns & Refunds (Non-Withdrawal)

Original Artworks

• Original artworks are generally non-returnable, unless required by law

Printed Editions

• Returns are accepted within the statutory withdrawal period

• Return shipping costs are the responsibility of the buyer

9. Copyright & Intellectual Property

All artworks remain the intellectual property of the artist, even after purchase.

The purchase of an artwork or print does not transfer copyright.

You may:

• Display the artwork for personal, non-commercial use

You may not:

• Reproduce or copy the artwork

• Use the artwork commercially

• Create digital reproductions or NFTs

• Sell reproductions or derivatives

Written permission from the artist is required for any additional use.

10. Resale of Artworks

Collectors may resell purchased artworks.

All reproduction, publication, and licensing rights remain with the artist unless otherwise agreed in writing.

11. Liability

I am not liable for:

• Minor color variations due to screen settings

• Delays caused by shipping providers

• Indirect or consequential damages, where legally permissible

Nothing in these Terms & Conditions limits liability where prohibited by law.

12. Privacy

Personal data is processed in accordance with the Privacy Policy on this website and used solely for order processing and communication.

13. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of the Federal Republic of Germany.

Place of jurisdiction is Heidelberg, Germany, insofar as legally permissible.
